Terms of Service

1. Definitions

In these Terms of Service, the following terms have the meanings indicated below:

• Platform: refers to the SenChange website and mobile application.
• User: any natural or legal person using the Platform's services.
• Services: all services offered by SenChange including the purchase, sale and exchange of cryptocurrencies and currency exchange.
• Account: the User's personal space on the Platform.

2. Purpose

These Terms of Service aim to define the terms and conditions for using the Services offered by SenChange.

3. Acceptance of Terms

Using the Platform implies full and complete acceptance of these Terms of Service. The User acknowledges having read these Terms and accepts them without reservation.

For any transaction exceeding 1500 USD, identity verification is carried out in person at our premises, in accordance with local financial monitoring practices.

4. Registration and User Account

4.1 Account Creation

To access the Services, the User must create an Account by providing accurate, complete and up-to-date information.

4.2 Confidentiality of Login Details

The User is solely responsible for the confidentiality of their login credentials and undertakes not to disclose them to third parties.

4.3 How It Works

The operation is as follows:
• Users pay in fiat currency (XOF) via Mobile Money.
• We then send them the purchased digital assets directly to their pre-registered wallet address.
• For sales, users transfer their digital assets to us, and we send them the equivalent in fiat via Mobile Money.
• We never store users' funds, nor do we hold custody of their wallets.

5. Services Offered

5.1 Digital Asset Exchange

SenChange enables the purchase, sale and exchange of digital assets for traditional currencies via mobile money (Wave, Orange Money, YUP).

SenChange is a decentralized application. We do not hold any users' digital assets. We act solely as a purchase and transfer service.

5.2 Currency Exchange

The Platform offers an exchange service between different currencies (EUR, USD, JPY to XOF and vice versa).

5.3 Limits and Restrictions

SenChange reserves the right to impose limits on transaction amounts and to suspend any account in case of suspicious activity.

Our application is exclusively usable in Senegal. We do not currently offer our services outside of Senegal.

6. Rates and Fees

Fees applicable to transactions are clearly indicated before validation of each operation. SenChange is committed to transparency in rates applied.

7. User Obligations

The User undertakes to:

• Provide accurate and up-to-date information
• Not use the Platform for illegal or fraudulent purposes
• Comply with regulations in force in their country of residence
• Not attempt to disrupt the normal operation of the Platform

8. Responsibilities

8.1 SenChange's Responsibility

SenChange implements all necessary means to ensure the quality and continuity of its Services. However, SenChange cannot be held responsible for interruptions due to force majeure.

8.2 User's Responsibility

The User is solely responsible for transactions made from their Account. SenChange declines all responsibility in case of errors in entering transaction information.

9. Personal Data Protection

SenChange is committed to protecting Users' personal data in accordance with current regulations. For more information, please consult our Privacy Policy.

10. Modification of Terms

SenChange reserves the right to modify these Terms of Service at any time. Modifications will take effect upon their publication on the Platform.

11. Applicable Law and Jurisdiction

These Terms of Service are governed by Senegalese law. Any dispute relating to their interpretation or execution shall fall under the exclusive jurisdiction of the courts of Dakar.
